Welcome to instaAI, a product owned and operated by Clorse Private Limited ("Company," "we," "us," or "our"). By accessing or using our website, www.instaai.pro, you agree to be bound by these Terms of Use ("Terms"). If you do not agree with these Terms, please refrain from using instaAI.

These Terms apply to all users ("you," "User") who access or use instaAI. Your use of instaAI implies your acceptance of these Terms, including the mandatory arbitration provision and class action waiver stated in Section 15 (Dispute Resolution; Binding Arbitration). Your continued use of instaAI confirms your acceptance of these Terms.

By using instaAI, you confirm that you are at least 18/21 years old (as required by your jurisdiction) and have the legal capacity to accept these Terms. If you use instaAI on behalf of an organization, you confirm that you are authorized to accept these Terms on its behalf.

1. Description of Service

instaAI is an AI-based software application that allows users with public Instagram profiles to upload their photos and generate hyper-realistic images of themselves based on text prompts. The application uses a custom-trained AI model to understand your face and create images according to your input.

By using the service, you acknowledge that the AI-generated images ("AI Images") created by instaAI are based on your uploaded content. We retain the right to modify or discontinue any part of the service at our sole discretion without prior notice.

2. Eligibility

To use instaAI, you must be of legal age in your jurisdiction and possess the necessary rights to upload content. If you become aware of anyone under the age of majority using instaAI, please notify us immediately at contact@instaai.pro.

3. User Accounts and Security

To access certain features of instaAI, you must buy a plan (Standard, Premium, Ultra). You agree to provide rights to use your Instagram profile pictures for training your custom AI. You are responsible for maintaining the confidentiality of your account login information and any activities that occur under your account. Please notify us immediately if you suspect any unauthorized use of your account.

We are not liable for any loss or damage arising from your failure to safeguard your account credentials.

4. Privacy

Please refer to our Privacy Policy for detailed information on how we collect, use, and handle your personal data. By using instaAI, you acknowledge and agree to our data handling practices as outlined in the Privacy Policy.

5. User Content

instaAI allows you to train your custom AI from your Instagram profile to generate AI Images. You retain ownership of the photos you upload and any AI Images generated by instaAI. We do not claim ownership over your content. However, by using instaAI, you grant us a limited, non-exclusive, worldwide, royalty-free license to use, store, and modify your content for the purpose of providing and improving the service.

Once the AI Images are generated, your original photos are deleted from our servers. However, we may retain the fine-tuned model for future use in generating new images for you.

6. Prohibited Conduct and Content

When using instaAI, you agree not to engage in any of the following:

  • Upload content that is illegal, harmful, or offensive, including explicit, defamatory, or infringing materials.
  • Use instaAI to create or distribute harmful, misleading, or deceptive AI Images.
  • Upload photos of individuals without their consent.
  • Violate any applicable laws or regulations in your jurisdiction.
  • Exploit instaAI for commercial purposes without proper authorization.

We reserve the right to monitor your use of instaAI and take necessary action, including suspending or terminating your account, if you violate these Terms.

7. Intellectual Property Rights

instaAI and all related content, including text, graphics, logos, and software, are the property of Clorse Private Limited or our licensors and are protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use instaAI for personal use only. Any unauthorized use of the service or its content will result in the termination of your license and potential legal consequences.

8. Purchases & refunds

Some features of instaAI are offered as a one-time purchase. By making a purchase, you agree to the pricing and payment terms presented at the time of purchase. If you are not happy with the images generated with insta AI, we will offer you renewal of image generation credits for retrial and if still you would like a refund, we will initiate refund in 1-3 days of request.

9. Feedback

We welcome your feedback on instaAI. Any feedback you provide will be considered non-confidential and will become the sole property of Clorse Private Limited. We may use and share your feedback for any purpose without compensation to you.

10. Indemnification

You agree to indemnify and hold harmless Clorse Private Limited, its officers, directors, and employees from any claims, liabilities, damages, or expenses arising from your use of instaAI, including your violation of these Terms or infringement of any third-party rights.

11. Disclaimers

instaAI is provided "as is" without any warranties, express or implied. We do not guarantee that instaAI will meet your expectations or that the service will be uninterrupted or error-free. We disclaim all liability for any harm arising from your use of instaAI, including any AI Images generated.

12. Limitation of Liability

To the maximum extent permitted by law, Clorse Private Limited shall not be liable for any indirect, incidental, or consequential damages arising from your use of instaAI. Our total liability shall not exceed the amount you paid to use instaAI.

13. Modifications to These Terms

We reserve the right to modify these Terms at any time. Changes will be posted on the instaAI platform, and your continued use of the service after such changes indicates your acceptance of the revised Terms.

14. Electronic Communications

By using instaAI, you consent to receive electronic communications from us, including service updates, promotional offers, and legal notices. You may opt-out of promotional emails at any time by following the unsubscribe instructions.

15. Termination

We reserve the right to terminate your access to instaAI at any time without notice for any reason. Upon termination, your right to use instaAI will cease, but Sections 7-16 of these Terms will continue to apply.

17. Miscellaneous

These Terms constitute the entire agreement between you and Clorse Private Limited regarding instaAI. If any provision is deemed invalid, the remaining provisions will remain in full force and effect. You may not transfer or assign your rights under these Terms without our written consent.
